The Document Must Be Complete
California notary law does not allow a notary to notarize a document with blank fields to be filled in later. Please leave only the signature lines blank.
The Signer Needs Valid Identification
A current, unexpired government-issued photo ID is required, such as a driver's license, state ID, or passport.
The Signer Must Be Mentally Competent
California law requires the person signing to understand the document and act willingly, without pressure from anyone else. If a patient is heavily sedated or unable to communicate, the appointment may need to be rescheduled.
Witnesses May Be Required
Certain documents, such as a Power of Attorney or a Will, may require one or two witnesses. Witnesses should not be named in the document or benefit from it.
Recent Surgery or Sedation
In many circumstances, patients who have recently undergone surgery or a procedure requiring sedation may need 24 hours to regain the alertness needed to sign. Our notary will always confirm that the signer is clear-headed and competent at the time of the appointment.
